Terms of Service
These terms are the agreement between you and Harding Ventures, LLC for using PlateWay. We’ve written them to be read. Please do.
The short version
- PlateWay is a nutrition and habits tool. It isn’t medical care or a medical device.
- AI estimates can be wrong. Check them and fix anything that’s off.
- Medication features are reminders only. Allergen checks aren’t a guarantee: check labels.
- PlateWay Plus renews automatically until you cancel it in your Apple account settings.
- Your data stays yours. You give us only the permission we need to run the app.
1. Agreeing to these terms
By using PlateWay, you agree to these terms and to our Privacy Policy, which explains how we handle your data. If you don’t agree, please don’t use the app.
“PlateWay”, “we” and “us” mean Harding Ventures, LLC, of Arlington, Virginia, USA, and the PlateWay app and website. “You” means the person using PlateWay.
2. Who can use PlateWay
You must be at least 13 years old (16 in the EEA and UK), and old enough to agree to these terms where you live. If you’re under 18, a parent or guardian should review these terms with you.
An adult account holder can add household members, including children, to plan meals for the household. You’re responsible for the details you add about them and for having the right to add them.
3. Your account
- You can sign in with an email link, Sign in with Apple, or Google, or use PlateWay as a guest without signing in.
- A guest account lives only with that sign-in on your phone. If you lose the phone or delete the app before saving your plan to an email, Apple or Google sign-in, we can’t recover it. Guest accounts that haven’t signed in for 365 days are deleted (see the Privacy Policy, section 7).
- Keep access to your email and devices secure. You’re responsible for activity on your account.
- Give us accurate information, so your targets and plans make sense for you.
4. PlateWay isn’t medical care
PlateWay is a general nutrition and habits tool. It is not medical advice, and it is not a medical device. It doesn’t diagnose, treat, cure or prevent any condition.
- Targets are general estimates from published formulas, with built-in calorie floors. They aren’t a prescription for you.
- Talk with a doctor, registered dietitian or other qualified professional before making big changes to how you eat, especially if you are pregnant or breastfeeding, have or have had an eating disorder, have diabetes, kidney disease or another health condition, or take medication.
- If you take a medication that changes appetite (for example a GLP-1 medication), work with your prescriber. PlateWay is designed to sit alongside their guidance, never to replace it.
- If a clinician gave you targets, follow them. You can enter them in the app.
- If you think you have a medical emergency, call your local emergency number.
5. AI estimates and suggestions
PlateWay uses AI to estimate the foods and nutrients in your photos and descriptions, to read menus and fridge photos, and to suggest meal plans and recipes. AI estimates can be wrong: portions, ingredients, and cooking methods are hard to judge from a photo.
- Check estimates and fix anything that’s off. Your corrections are saved.
- Recipes and plans are suggestions. Use your own judgment about ingredients, portions, cooking times and food safety, such as cooking meat through.
- When PlateWay changes a target or a plan, it tells you why. You can always change it back.
6. Medications, allergens and alcohol
- Medications and supplements: these features are reminders only. They are scheduled on your phone, and they rely on your phone’s notifications being on and working. PlateWay never gives dosing guidance and never tells you to start, stop or change a medication. Notes you add, like “take with food”, are your own. Don’t rely on PlateWay as your only reminder for a medication that matters to your health.
- Allergens: PlateWay checks recipes, plans and grocery lists against the allergens you enter, but it can miss things. Ingredients and labels change, and AI can misread a photo or a menu. A check is not a guarantee that a food is safe for you. Always check labels, and ask when eating out.
- Alcohol: PlateWay can count drinks you log. Nothing in the app says how much alcohol is safe for you, and we guarantee nothing about alcohol safety.
7. Grocery lists and other services
You can share a grocery list through your phone’s share sheet to Messages, Notes, a grocery app or anywhere else you choose. Prices shown in PlateWay are estimates. Anything you buy, and its price, delivery and quality, is between you and that grocer, under their terms.
PlateWay links to or uses other services (such as Apple, Google, USDA FoodData Central and Open Food Facts). We aren’t responsible for their content or how they run.
8. PlateWay Plus and payments
The free version
PlateWay is free to download. The free version includes typed logging, barcode logging where available, water, sleep and medication reminders, your targets and Today view, and all privacy controls. New accounts also get 5 photo scans and their first week’s meal plan free.
PlateWay Plus
PlateWay Plus is an optional, auto-renewing subscription that unlocks the features marked Plus in the app, such as photo scanning beyond your first 5 scans and new meal plans after your first week.
- Price: $12.99 a month or $79.99 a year in the US. Prices in other countries are shown in the App Store before you buy, and may include tax.
- Free trial: new subscribers get a 7-day free trial. Apple decides who is eligible. If you buy a subscription during a free trial, any unused part of the trial ends.
- Payment: charged to your Apple ID when you confirm the purchase, or at the end of the free trial.
- Renewal: the subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- Managing and cancelling: in your Apple account settings. On iPhone, open Settings, tap your name, then Subscriptions. Cancelling stops the next renewal. Plus stays on until the end of the period you’ve paid for. Deleting the app or your PlateWay account does not cancel the subscription.
- Refunds: Apple handles all payments and refunds, under its policies. You can ask for a refund at reportaproblem.apple.com. We can’t issue refunds ourselves.
- Price changes: if the price changes, Apple tells you first and, where required, asks you to agree before you’re charged the new price.
- When Plus ends: nothing is deleted. Your logs, plans, recipes and photos stay, and you keep using the free version.
We may change which features are free or Plus. If we take away a Plus feature you’re paying for, we’ll tell you in the app.
9. Your content
Your photos, logs, notes, recipes and other things you add are yours. You give us a limited, non-exclusive, worldwide, royalty-free permission to store, copy, process and display them only to run PlateWay for you, to improve its estimates (for example, learning from your corrections), and to keep it safe. This permission ends when you delete the content or your account, except for copies in short-term backups until they’re replaced, or where the law requires us to keep something.
You’re responsible for what you add. Only add photos and information you have the right to share.
If you send us feedback or ideas, we may use them to improve PlateWay without owing you anything.
10. Acceptable use
Please don’t:
- Break the law, or use PlateWay to harm yourself or anyone else.
- Upload content that is illegal, sexual, hateful, or someone else’s private information without their permission.
- Try to get into accounts or data that aren’t yours, or to get around security or usage limits.
- Reverse engineer, copy, resell or rebuild the app, except where the law allows it.
- Scrape PlateWay, use bots or scripts against it, or overload our servers or AI features.
- Use PlateWay to build a competing product or to train AI models.
- Pretend to be someone else, or misrepresent your connection to anyone.
11. Our app and intellectual property
PlateWay, its design, code, recipes we write, text and branding belong to Harding Ventures, LLC or our licensors. We give you a personal, non-transferable, non-exclusive, revocable licence to use the app on devices you own or control, for your own non-commercial use, under these terms. We keep all other rights.
Some data comes from others and stays under their licences: nutrition data from USDA FoodData Central (public domain) and barcode product data from Open Food Facts contributors (Open Database License). Credits are in Settings › About.
12. Apple and the App Store
If you got PlateWay from the Apple App Store, Apple’s Licensed Application End User License Agreement (the Standard EULA) also applies. If it conflicts with these terms, these terms win where the law allows, except for the points below, which always apply:
- These terms are between you and Harding Ventures, LLC, not Apple. We, not Apple, are responsible for PlateWay and its content.
- Your licence lets you use PlateWay on Apple-branded devices you own or control, as the App Store’s Usage Rules allow (including Family Sharing, where available).
- We, not Apple, provide support and maintenance for PlateWay. Apple has no duty to provide any.
- If PlateWay fails to meet any warranty that applies by law, you can tell Apple, and Apple will refund the price you paid for the app (if any). Beyond that, and as far as the law allows, Apple has no warranty obligation for PlateWay. Any other claims, losses or costs from a failure to meet a warranty are ours to deal with, as these terms describe.
- We, not Apple, are responsible for handling any claims about PlateWay from you or anyone else. That includes product liability claims, claims that PlateWay doesn’t meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If someone claims that PlateWay or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.
- You confirm that you are not in a country under a U.S. government embargo, or one the U.S. government has named as supporting terrorism, and that you aren’t on any U.S. government list of prohibited or restricted parties.
- You must also follow the terms of any third party you use with PlateWay, such as your mobile carrier.
- Apple and its subsidiaries are third-party beneficiaries of these terms. That means once you accept these terms, Apple has the right to enforce them against you.
Questions, complaints or claims about PlateWay go to us: Harding Ventures, LLC, Arlington, Virginia, USA, support@hardingventuresllc.com.
13. Ending your use
- You can stop using PlateWay at any time, and delete your account in Settings › Your data › Delete account. Remember to cancel any subscription in your Apple account settings too.
- We may suspend or close an account that seriously or repeatedly breaks these terms, puts others at risk, or where the law requires it. Where we reasonably can, we’ll tell you first and give you a chance to export your data.
- We may change, pause or stop parts of PlateWay. If we shut PlateWay down, we’ll give you reasonable notice and time to export your data.
- Sections 9 to 11 and 14 to 17 still apply after your use ends, where they make sense.
14. Disclaimers
We work hard to make PlateWay useful and accurate, but we provide it “as is” and “as available”. As far as the law allows, we make no promises, express or implied, about its accuracy, availability or fitness for a particular purpose, or that it will be free of errors. That includes nutrition estimates, AI suggestions, allergen checks, recipes, prices and reminders. Some places don’t allow these exclusions, so some may not apply to you.
15. Limitation of liability
As far as the law allows, Harding Ventures, LLC and its owners and team won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of PlateWay, even if we were told they were possible.
As far as the law allows, our total liability for any claim about PlateWay is limited to the amount you paid for PlateWay Plus in the 12 months before the claim, or $50, whichever is more.
Nothing in these terms limits liability that can’t be limited by law, such as for fraud, or for death or personal injury caused by negligence, and nothing takes away rights you have as a consumer under the law where you live.
16. If you break these terms
As far as the law allows, if a claim is brought against us because you broke these terms or the law, or because of content you added, you agree to cover our reasonable costs from it, including legal fees.
17. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-law rules. If something goes wrong, please email us first. Most problems can be fixed that way. If we can’t settle it, any dispute will be heard in the state or federal courts located in Virginia, and you and we agree to their jurisdiction.
If you live in the EEA, the UK or another place whose consumer laws give you the right to bring a claim at home, or under your local law, you keep that right.
If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce a part right away, we haven’t given up the right to do so later. You can’t transfer these terms to someone else. We may transfer them if PlateWay is sold or merged, and we’ll tell you. These terms, the Privacy Policy, and Apple’s Standard EULA where it applies, are the whole agreement between you and us about PlateWay.
18. Changes to these terms
We may update these terms as PlateWay changes. We’ll update the date at the top. If a change is significant, we’ll tell you in the app before it takes effect. If you keep using PlateWay after that, you accept the new terms. If you don’t, you can delete your account at any time.
